Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Surfacely (https://www.surfacely.me), operated by Group Alba Nova Limited (company number SC838019), trading as Surfacely("we", "us", "our"). By using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Who may use the service

You must be at least 18 years old and have authority to bind yourself or the organisation you represent. You must only submit domains you own or have explicit permission to audit. You are responsible for ensuring your use complies with applicable law.

3. The service

Surfacely provides generative engine optimisation (GEO) audits of publicly accessible web pages. We crawl, analyse, and score how well your site may be understood and cited by AI-driven search experiences. Reports include prioritised recommendations and, on paid plans, export-ready fix guidance.

The service is advisory only. We do not guarantee improved AI visibility, search rankings, traffic, or revenue. Results depend on many factors outside our control, including third-party AI systems.

We analyse only publicly accessible pages — the same surface an AI crawler could reach without logging in. We do not access your store database, admin panels, or authenticated areas unless you separately connect an integration when we make one available.

4. Accounts

Some features require a registered account with a verified email address. You are responsible for keeping your credentials secure and for activity under your account. Notify us promptly at support@surfacely.me if you suspect unauthorised access.

5. Plans and usage limits

We may enforce limits automatically. Attempts to circumvent limits (including creating multiple accounts to evade quotas) may result in suspension.

6. Payments and billing

Paid subscriptions are processed by Stripe. By subscribing, you authorise recurring charges at the price shown at checkout until you cancel. Prices are shown in the currency presented at checkout and may exclude taxes, which you are responsible for where applicable.

We may change prices for future billing periods with reasonable notice. Changes apply on renewal unless you cancel before the change takes effect.

7. Auto-renewal, cancellation, and refunds

Subscriptions renew automatically each billing period until cancelled through Manage billing in your account (Stripe Customer Portal). If you cancel, you retain paid access until the end of the current billing period, after which your account reverts to free-tier limits.

Fees are non-refundable except where required by applicable law. We do not provide pro-rata refunds for partial billing periods.

8. Acceptable use

You agree not to:

• Submit domains you do not own or lack permission to audit
• Use the service to scrape, overload, or disrupt third-party sites beyond normal audit crawling
• Attempt to bypass rate limits, quotas, or access controls
• Reverse engineer, resell, or sublicense the service without permission
• Use the service for unlawful or harmful purposes

We may suspend or terminate access for violations, abuse, or risk to the platform or third parties.

9. Intellectual property

We own the platform, software, branding, and report formats. You retain ownership of your website content. We grant you a limited licence to use audit reports for your internal business purposes. You may not republish reports as a competing service without our written consent.

10. Third-party services

The service relies on third parties including payment processors, cloud hosts, email providers, and AI model providers. Your use of those services may be subject to their terms. We are not responsible for third-party outages or policy changes.

11. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim arising from the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the service, your violation of these Terms, or audits of domains you were not authorised to submit.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be notified by email or in-product notice. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Scotland. The courts of Scotland have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
